Key Highlights of the New Crypto Tax Laws:

  1. Capital Gains Tax (CGT) Adjustments: The UK’s approach to crypto assets will continue to treat them similarly to other forms of property. This means that capital gains from the disposal of crypto assets will be subject to Capital Gains Tax. The rates of taxation will depend on the individual’s income tax band, with basic rate taxpayers paying 10% on gains, and higher and additional rate taxpayers paying 20%.
  2. Crypto Gifts and Donations: Gifting crypto to someone other than your spouse or civil partner will potentially trigger a CGT event for the giver, based on the market value of the crypto at the time of the gift. Conversely, donations to charity may offer relief from CGT, provided certain conditions are met.
  3. Staking and Mining: Income received from staking or mining activities is considered taxable income. The distinction between hobbyist and business activities will determine how this income is taxed, with potential implications for how expenses are deducted.
  4. Airdrops and Hard Forks: Crypto received from airdrops may be considered taxable income, particularly if received in exchange for a service. The treatment of assets acquired through hard forks will require careful consideration of the cost basis for tax purposes.
  5. Reporting and Compliance: The UK tax authority, HMRC, emphasizes the importance of accurate record-keeping and reporting for all crypto transactions. This includes maintaining detailed records of transaction dates, amounts, and the GBP value of transactions.
  6. Regulatory Framework Enhancements: Alongside tax adjustments, the UK government is working to establish a comprehensive regulatory framework for digital assets. This includes proposed rules for stablecoins, marketing regulations for crypto firms, and initiatives to integrate crypto businesses into existing financial regulations.
